Terms of service

The rules for using the free services of the site.

Last updated

Informational translation of version 1.2 of the Polish document (effective from 20 November 2026). The Polish version is binding. Parts of the terms describe functions available on substraty.pl (client panel, company directory, paid services) that are not part of this English edition yet; they are translated for completeness.

§ 1. General provisions

  1. These terms set out the types, scope and conditions of providing free services by electronic means on the website substraty.pl and on its language versions run under the feedstockdata.com domain (together the “Site”), and the complaints procedure — in accordance with Article 8 of the Polish Act of 18 July 2002 on the provision of electronic services (the “Electronic Services Act”).
  2. The service provider is Samael Spółka z ograniczoną odpowiedzialnością (Samael Sp. z o.o.), registered office in Tarnów, Czarna Droga 84, 33-101 Tarnów, Poland, KRS 0000503734, NIP 9930654255, REGON 123072381 (the “Provider”). Contact: contact@feedstockdata.com (for the Polish edition: biuro@substraty.pl). Full details: Legal notice.
  3. Paid services (the Listing Plus and Expert Profile packages of the company directory, the individually concluded Strategic Partner Package, sponsored articles with language versions, the editorial article in the Expert Profile package and BMP laboratory tests) are governed by the Terms of paid services (available in Polish on substraty.pl). The newsletter is governed by the Newsletter terms. Personal data: Privacy policy; cookies: Cookie policy. These documents apply in the versions shown in their headers; until the new version takes effect (20 November 2026) the existing versions apply.
  4. These terms are available free of charge at substraty.pl/regulamin/ in a form that can be downloaded, saved and printed (Article 8(1)(2) of the Electronic Services Act), and in the version archive on that page.
  5. The company directory is publicly available on the Site from the Directory launch day — 1 January 2027. Before that day a User can prepare a company listing in the Panel (the Listing wizard), and the Editorial Team can verify and moderate it; listings are published from the Directory launch day. The provisions of these terms on order in the directory, the “Recommended companies” section and package labels apply from the Directory launch day.

§ 2. Definitions

  • User — anyone using the Site.
  • Consumer — a User who is a natural person using the Site for purposes not directly related to business or professional activity (Article 22¹ of the Civil Code).
  • Panel — the client panel of the company directory at substraty.pl/panel/.
  • Account — a User’s account in the Panel.
  • Editorial content — compendium articles, FAQ answers, substrate descriptions, the BMP data compilation and process data prepared by the Substraty.pl Editorial Team.
  • User content — data and materials provided by a User, in particular data and materials of a company profile in the directory.
  • Editorial Team — the Substraty.pl / FeedstockData Editorial Team, i.e. employees of the Provider (Samael Sp. z o.o.) who prepare editorial content, verify and moderate User content and correspond with Users.
  • Company directory — the directory of industry companies kept on the Site (§ 7).
  • Directory launch day — 1 January 2027, the day from which the Company directory is publicly available on the Site.
  • Listing — a company profile in the Company directory: in the free Listing package or in a paid package.
  • Listing wizard — a Panel function for preparing a Listing, whose first step is to give the company’s country and tax identifier (§ 7(2)).
  • Correspondence with the Editorial Team — a Panel function for sending the Editorial Team requests, questions, complaints and problem reports and receiving replies (§ 6(8)).
  • AI listing assistant — a function of the Listing wizard that, on the basis of the NIP (data from the VAT taxpayers’ register or VIES) and the company’s public website, uses an artificial-intelligence model to prepare a proposal of a Listing for the User to check (§ 7(2)(6)).
  • Partner laboratory — a BMP testing laboratory cooperating with the Provider, named in the Panel (§ 3(9)).

§ 3. Types and scope of free services

The Provider supplies the following services free of charge:

  1. Knowledge compendium — making available articles, FAQ answers, the archive, the Site search and RSS feeds.
  2. BMP database and open data — making available the compilation of biochemical methane potential (BMP) test results with a bibliography, charts, a substrate comparison tool and files to download (JSON, CSV) under the Data licence.
  3. The co-digestion calculator and other calculation tools (§ 5).
  4. Company directory — the free Listing package — a free presentation of an industry company (name, city, service categories, short description, link to the company website), also prepared by the Editorial Team from public sources. A company that also operates outside Poland may, at no extra charge, choose to publish its Listing in FeedstockData as well (§ 7(10)). A Listing can be prepared in the Panel in the Listing wizard; it is published from the Directory launch day, after verification by the Editorial Team (§ 7).
  5. Panel account — registration, login (including two-step login), taking over a company profile, preparing and editing a Listing (including in the Listing wizard and with the help of the AI listing assistant), uploading materials, viewing profile statistics, Correspondence with the Editorial Team, the “Request laboratory contact” form (§ 6–§ 7).
  6. Contact forms — the form for contacting a company in a directory profile and the company submission form, which prepare a message in the User’s e-mail client (the Provider is not an intermediary of this correspondence until it is sent to its address).
  7. Newsletter — under separate terms.
  8. Correspondence with the Editorial Team — sending requests, questions, complaints and problem reports to the Editorial Team in the Panel and receiving replies (§ 6(8)).
  9. Request laboratory contact — a form in the Panel (BMP testing tab) in which the User gives a phone number and contact details and — voluntarily — consents (version badania-kontakt@1.0) to passing them to the partner laboratory’s contact person for a phone call about BMP testing. The Provider is not a party to any contract between the User and the laboratory and does not undertake to order a test; after the data are passed, the laboratory is a separate controller of the data for further contact (see the Privacy policy). The Provider keeps the request and proof of consent and settles with the laboratory for passed contacts — for which it may receive remuneration from the laboratory. Consent can be withdrawn at any time by writing to the contact address; withdrawal does not affect the lawfulness of passing before withdrawal. The form is available no more than once every 24 hours.

§ 4. Technical requirements and risks

  1. To use the Site you need a device with internet access and a current web browser (e.g. Chrome, Firefox, Safari, Edge in a version supported by its maker). The calculator, filters, interactive charts and the Panel require JavaScript; the Panel also requires necessary cookies (see the Cookie policy). An Account requires an e-mail address; two-step login requires an app generating TOTP codes. A PDF reader is needed to read PDF documents.
  2. The basic content of the Site is also available without JavaScript.
  3. Information on special risks (Article 6 of the Electronic Services Act): using the internet involves risks including malware, phishing and account takeover. The Provider never asks for your password by e-mail or phone. We recommend a unique password, two-step login and up-to-date software. Links to external sites (sources, company sites) lead to services whose owners are responsible for them.
  4. The Site installs no software on the User’s device. It stores in browser storage only the information described in the Cookie policy.

§ 5. Editorial content, BMP data and the calculator

  1. Editorial content is informational and educational. It describes the state of knowledge and law on the date of publication (or on the date given in the “Update” note). It is not legal, tax, technical or investment advice on a specific project. Editorial content (including translations) is prepared with the help of artificial-intelligence tools and checked by the Editorial Team, which is editorially responsible for it (editorial principles on substraty.pl).
  2. BMP data come from the publications cited and describe laboratory test results. Weighted means and ranges are a descriptive compilation, not a guarantee of yield in a plant. The principles of the compilation are described in the methodology.
  3. The co-digestion calculator computes results from data entered by the User, means from the BMP database and a simplified model. Results are an estimate of an illustrative nature: they do not replace a BMP test of samples from a specific source, a technological design, a feasibility analysis or a technologist’s opinion. The process assessment (risk messages) rests on rules with cited sources and does not cover all factors affecting digestion stability. Before an investment decision or a change of feedstock, verify the results with a specialist.
  4. The calculator runs in the User’s browser: data entered are stored only in the page address (so that a link can be shared) and are not sent to the Provider.
  5. The Provider takes care that content and calculations are reliable and current, and corrects reported errors under the editorial principles and corrections policy.
  6. Language versions. The English and German versions (and others, when made available) are run under the feedstockdata.com domain, translated with AI assistance and checked by the Editorial Team. In the event of discrepancies the Polish version of the content, these terms and the other legal documents is binding; translations of documents (where made available) are informational.

§ 6. Panel account

  1. Creating an Account is free. It requires an e-mail address, a password (at least 10 characters), acceptance of these terms and confirmation of the e-mail address with a link valid for 48 hours. The contract for the Account is concluded on confirmation of the e-mail address, for an indefinite period. A Consumer and a User with consumer rights may withdraw from the contract within 14 days of its conclusion without giving a reason — it is enough to delete the Account in the Panel or write to the contact address (to the extent that provisions on withdrawal apply to this contract).
  2. The Account serves companies and their representatives. By creating an Account for a company, the User declares that they are authorised to act on its behalf.
  3. Taking over a profile of a company existing in the directory happens automatically when the domain of the Account’s e-mail address matches the domain of the company’s website (excluding free mailboxes). In other cases the Provider decides and may ask for a document confirming authority (e.g. a register extract, a power of attorney). The Provider may also at any time ask for such confirmation and suspend access to the profile until it is received if it has justified doubts about authority (e.g. expiry or takeover of the domain).
  4. The User is responsible for the confidentiality of the password and backup codes. We recommend switching on two-step login (TOTP). The Panel limits the number of failed login attempts and records security events (see the Privacy policy).
  5. The User may delete the Account in the Panel at any time (“Account and security”), which terminates the contract for the Account (Article 7(2) of the Electronic Services Act). Deleting the Account does not affect ongoing contracts for paid services (they end at the end of the paid period), does not remove accounting documents kept under the law, a published Listing or company data published in a Listing on the basis of public sources (objection to publication — § 7(6)). Before the Account is deleted the Panel informs about ongoing paid services; until the end of the paid period the User may exercise rights under the contract by e-mail, and the e-mail address is processed until the contract ends and is settled.
  6. The Provider may terminate the contract for the Account with 14 days’ notice for important reasons (ending the Panel service, a change in law that prevents providing it), and with immediate effect where the User grossly breaches the terms (e.g. impersonates another company, publishes illegal content, attacks the Site’s infrastructure), after an unsuccessful call to stop the breaches, unless a call is pointless given the nature of the breach. The Provider may also block the Account while it clarifies a suspicion of takeover of the Account by an unauthorised person. The User is informed of a block and its reasons by e-mail (Article 17 DSA).
  7. Commercial information by e-mail. At registration or in the Listing wizard the User may — voluntarily — consent to receiving commercial information about the Site’s services from the Provider at the Account’s e-mail address (Article 398 of the Polish Electronic Communications Law of 12 July 2024). The consent box is unticked by default; lack of consent does not affect creating an Account or using the Site’s services. Consent can be withdrawn at any time in the Panel, free of charge and without giving a reason; withdrawal does not affect the lawfulness of mailings before withdrawal. Messages related to the Account and contracts (e.g. confirmations, reminders, notifications of Editorial Team replies) are not commercial information.
  8. Correspondence with the Editorial Team. In the Panel the User may send the Editorial Team requests, questions, complaints (§ 11) and problem reports, in particular concerning the Listing, payments and invoices, articles, BMP tests and the operation of the Panel. Replies of the Editorial Team are visible in the Panel, and the User is notified of each new reply by e-mail at the Account address. Correspondence is handled by the Provider’s employees. E-mail contact at the contact address remains available.

§ 7. Company directory and User content

The provisions of this section apply to the Company directory, which is publicly available from the Directory launch day; before that day they apply to the preparation and moderation of Listings in the Panel.

  1. The directory covers companies operating in the biogas, biomethane, waste-to-energy and waste management industries. A Listing is free.
  2. Company data in the directory come from companies’ official websites, public registers (KRS, CEIDG, REGON, VAT taxpayers’ register) or from the companies themselves. We give the verification date with each profile. The Listing wizard in the Panel works as follows:
    1. In the first step the User gives the company’s country and tax identifier.
    2. Polish companies — after the NIP is given, the Panel fetches company data (including name, address, REGON, KRS and VAT status) from the public VAT taxpayers’ register (“white list”) kept by the Head of the National Revenue Administration and made available by the Ministry of Finance (wl-api.mf.gov.pl).
    3. Companies from other European Union states — the Panel checks the EU VAT number in the European Commission’s VIES system (validity of the number and — if the Member State makes them available — name and address).
    4. Companies from outside the European Union — the User enters the data manually.
    5. The User checks and completes the fetched data before submitting the Listing. All data, including those fetched from registers, are verified by the Editorial Team before publication (point 5). The result of an automatic register check does not decide publication.
    6. AI listing assistant. The User may — voluntarily — use the AI listing assistant: after the company’s website address is given, the Panel fetches its publicly available content and passes it, with the company’s register data (for a sole proprietorship — also the entrepreneur’s name), to the AI model provider, which prepares a proposal of a Listing. The proposal is marked in the Panel and is not published automatically. The User is responsible for checking and correcting the proposal; before saving the Listing the User confirms that the data and descriptions are accurate and that the company has the right to publish them. The company, not the AI assistant, is responsible for the truth and lawfulness of the content of the Listing; publication follows the company’s consent (point 9) and verification by the Editorial Team (point 5). The Panel saves all text fields of the Listing regardless of package, and the package decides what is published. Rules on the processing of data by AI providers are in the Privacy policy.
  3. Order in the directory: the Strategic Partner (if any, under an individual contract), then the Expert Profile package, Listing Plus and a Listing in the Listing package, and within a group — alphabetically (unless the User chooses another sort order). A position in the Expert Profile group does not mean first place among all companies. A higher position and the “Recommended companies” section next to compendium articles result from a paid package and are labelled as such (Article 7(11a) of the Polish Act of 23 August 2007 on counteracting unfair market practices; Article 5 of Regulation (EU) 2019/1150 — where applicable).
  4. A User who adds or changes User content undertakes that it is true, current, related to the industry and lawful, in particular that it does not infringe copyright, trademarks, personality rights or the trade secrets of third parties. Supplying unlawful content is prohibited (Article 8(3)(2)(b) of the Electronic Services Act), including misleading content, content disparaging competitors, spam and malware. The User bears sole responsibility for the truth and accuracy of data entered manually (including for companies from outside the European Union) that are not verified in a register.
  5. Moderation. Profile changes are published after verification by the Editorial Team. The Editorial Team checks data against sources and may refuse to publish all or part of the changes if they breach point 4, cannot be verified, are unrelated to the industry or are unlawful advertising. Decisions are taken by a human; the Panel automatically verifies only the file format (type, size, no active content in a PDF) and removes metadata (EXIF, GPS) from images. The User receives information about a refusal with reasons in the Panel or by e-mail (Article 17 DSA) and may, within 6 months of receiving the decision, lodge an appeal in the Panel (“Correspondence with the Editorial Team”) or at the contact address — it is examined by a person other than the author of the decision, if possible, within 14 days. This procedure also applies to appeals against a decision terminating a paid-service contract and refusing publication under such a contract.
  6. A company’s objection to an entry. A company (or a person running a sole proprietorship) whose data were published in the directory without its involvement may demand rectification of the data or deletion of the entry by writing to the contact address. The Provider deletes the entry without delay, no later than within 14 days, unless it demonstrates compelling legitimate grounds for continued publication — for natural persons under Article 21 GDPR, and for legal persons and organisational units — where publication does not infringe their personality rights and is not unlawful.
  7. The User grants a licence for materials uploaded in the Panel (logo, photographs, documents) in the declaration made at each file upload; its content and scope are set out in the Terms of paid services (§ 9), which also apply to Accounts without a paid package.
  8. Profile statistics (views, clicks on contact details and on the company’s website) are informational. They are counted without cookies and without storing IP addresses (see the Privacy policy).
  9. Publication of a Listing prepared in the Panel. A Listing prepared in the Panel is published when all of the following hold: the Editorial Team has accepted its content (point 5), the Directory launch day has occurred, and the User — as a person authorised to act on behalf of the company (§ 6(2)) — has given consent in the Panel to publish the Listing and has not withdrawn it. Consent is a declaration of the company on publishing its Listing; it is not consent within the meaning of Article 6(1)(a) GDPR (the bases for processing personal data are described in the Privacy policy). Consent can be withdrawn at any time in the Panel; withdrawal suspends publication of data and materials provided in the Panel and does not affect the lawfulness of publication before withdrawal. Withdrawal of consent does not terminate an ongoing paid-service contract and does not in itself give a right to a refund. Point 6 applies to an entry in the Listing package prepared by the Editorial Team from public sources.
  10. Publication of a Listing in FeedstockData. Every directory package — including the free Listing package — includes, at no extra charge, the option of publishing the Listing also in the international FeedstockData service at feedstockdata.com, run by the Provider (twin of the Site, in language versions — the English version is currently being prepared, further languages will be added), if the company’s area of operation given in the Listing includes at least one country outside Poland (or “worldwide”). The option is available in the Panel (Listing editing and the Listing wizard), is off by default and requires deliberate ticking by a User authorised to act on behalf of the company; ticking includes consent within the meaning of point 9 with regard to FeedstockData (the text of the consent, its version and date are recorded). If the area of operation is changed so that it includes no country outside Poland, the option is switched off. The description of the Listing and its other text content are translated into the language of the service version by the Editorial Team using AI-assisted translation and verified by the Editorial Team; a Listing is not published in a given language until the translation has been prepared and verified. The Polish version is binding (§ 1(1)). Publication follows acceptance of the content by the Editorial Team (point 5), no earlier than the launch of the given FeedstockData language version. The User may switch the option off at any time in the Panel — the Listing is then removed from FeedstockData; switching off does not affect publication on the Site or the lawfulness of publication before switching off. The type of package does not affect the availability of the option; the scope of presentation in FeedstockData corresponds to the scope of the package on the Site.

§ 8. Reporting illegal content

  1. Anyone may report content on the Site that they consider illegal or in breach of these terms (Article 16 DSA) by writing to contact@feedstockdata.com. A report should contain: an explanation of why the content is illegal; the exact address (URL) of the content; the name and e-mail address of the person reporting (not required for reports concerning offences against children); a statement that the person acts in good faith and believes that the information in the report is correct and complete.
  2. The Provider confirms receipt of the report, examines it without undue delay in a diligent, non-arbitrary and objective manner and informs the reporting person of the decision. The Provider does not use automated means of decision-making for this.
  3. If the Provider removes content, blocks access to it, restricts its visibility or suspends an Account, it gives the User concerned a statement of reasons containing the information required by Article 17 DSA, including on the possibility of appeal (§ 7(5)), of seeking redress in court and — where applicable — of using out-of-court dispute settlement before a body certified under Article 21 DSA.
  4. The Provider promptly notifies law enforcement authorities of information giving rise to a suspicion of a criminal offence involving a threat to the life or safety of persons (Article 18 DSA).
  5. A User may lodge a complaint about a breach of DSA obligations with the Digital Services Coordinator — the President of the Office of Electronic Communications (Article 53 DSA) — and, in matters infringing consumers’ interests, with the President of the Office of Competition and Consumer Protection (UOKiK).
  6. Reports of factual errors and requests for correction of editorial content are handled under the editorial principles and corrections policy.

§ 9. Rights to the Site’s content

  1. Editorial content and the layout of the Site are protected by copyright and database law. Use within fair use is permitted, in particular the right of quotation (Article 29 of the Polish Copyright Act), giving the source “Substraty.pl” / “FeedstockData” and a link.
  2. The BMP data compilation and files in the “Open data” section may be used under the Data licence. Photographs from Wikimedia Commons — under the licences stated in the captions.
  3. Mass, automated downloading of content in a way that burdens the Site or circumvents safeguards is prohibited; use the JSON/CSV files provided to download data. The Site’s editorial content may be indexed and used by search engines and artificial-intelligence systems, including to train models; quotation requires giving the source with a link. This permission does not cover companies’ materials, User content, Sponsored articles, photographs and other works of licensors — their licence terms and separate reservations apply to those.

§ 10. Liability

  1. The Provider takes care that the Site works without interruption and securely, but may temporarily restrict access to the Site because of technical work, failures or security threats; it informs of planned work in the Panel in advance where possible.
  2. Towards Consumers the Provider is liable under generally applicable law; these terms neither exclude nor limit that liability.
  3. Towards Users who are not Consumers (or persons referred to in Article 385⁵ of the Civil Code) the Provider, given the free nature of the services in § 3, is not liable for damage resulting from decisions taken solely on the basis of informational content or calculator results, except for damage caused intentionally or through gross negligence (Article 473(2) of the Civil Code).
  4. The User who supplied User content is responsible for it. As a hosting service provider the Provider is liable for such content under Article 6 DSA.

§ 11. Complaints

  1. Complaints about free services can be submitted in the Panel (“Correspondence with the Editorial Team”, § 6(8)), by e-mail to the contact address or by post to the Provider’s address. A complaint should give an e-mail address (or another reply address), a description of the problem and — if possible — the address of the page concerned.
  2. The Provider replies to a complaint within 14 days of receiving it, to the e-mail address given in the complaint or — for a complaint submitted in the Panel — to the Account’s e-mail address; a reply to a complaint submitted in the Panel is also visible in the Panel (for a Consumer we give the reply on a durable medium).
  3. A Consumer may use out-of-court ways of resolving disputes, including the help of a county (city) consumer ombudsman, the Voivodeship Inspectorate of Trade Inspection or consumer organisations. Information (in Polish): prawakonsumenta.uokik.gov.pl.
  4. A Consumer (and a User with consumer rights) has the rights for lack of conformity of a digital service (the Account, Panel tools) with the contract provided for in the Polish Consumer Rights Act, to the extent those provisions apply.

§ 12. Changes to the terms

  1. The Provider may change the terms for important reasons: a change in law or case law, a decision of an authority, a change in the scope or manner of providing services (adding, changing or withdrawing functions), a need to improve security, prevent abuse or remove ambiguity.
  2. The new version is published on the Site at least 14 days in advance (with a highlighted description of changes and an archive of previous versions); that period does not apply where an immediate change is required by mandatory law or dictated by urgent security considerations. Users with an Account are additionally informed by e-mail. A User who does not accept the changes may delete the Account before they take effect (Article 384¹ of the Civil Code).
  3. A change does not affect rights acquired before it takes effect or ongoing paid-service contracts in the paid period.

§ 13. Final provisions

  1. Polish law applies. The choice of law does not deprive a Consumer of the protection granted by provisions that cannot be excluded by contract, of the law of the country of their habitual residence.
  2. Disputes with Consumers are decided by courts competent under general rules. Disputes with Users who are entrepreneurs (except persons referred to in Article 385⁵ of the Civil Code) are decided by the court competent for the Provider’s registered office.
  3. The terms apply from the day stated in the document header.
  4. The Polish version of the terms is binding. Any translation of the terms is informational.
